Substitution Policy

In instances where specific floral requests are unavailable due to regional scarcity or seasonal limitations, our professional designer will appropriately substitute floral to maintain the intended aesthetic and thematic elements of the original arrangement. In the event that our service or the quality of our flowers does not meet your expectations, we encourage you to reach out to us without delay so we can address your concerns promptly. Our commitment is to provide satisfactory resolutions to any issues that may arise.

Please read this disclaimer carefully before handling and making any product purchases. By handling product before, during or after making a purchase, you acknowledge and accept the terms and conditions outlined below.

Our company is not liable for any adverse effects or damages resulting from the use of our products. By handling, purchasing and using our products, you acknowledge and accept this limitation of liability for all individuals, including children and animals, such as family pets.

Products included, but not limited to fresh floral and greens, giftware, supplies utilized for custom arrangements, silk floral, any product utilized to maintain freshness and integrity of our products.

Delivery Policy

We strive to honor delivery requests, though we cannot unequivocally guarantee specific times of delivery. Accurate and complete recipient information is the customer's responsibility, and any delivery delays caused by erroneous or insufficient details will not result in a refund. Adverse weather conditions may impede our ability to deliver as scheduled. Should this occur, we will complete the delivery at the next feasible opportunity. It is important to note that once an order has been dispatched or is in the process of being delivered, it is beyond the point where alterations or cancellations are feasible. To modify or cancel an order that has not yet been sent, please contact our studio by phone for changes or cancellations as these cannot be processed through any other means of communication.

Payment and Fees

We accept Visa, MasterCard, American Express, Discover, Apple Pay, and Google Pay. We want to ensure that when you place an order with us whether verbal or written, you are entering into a legal agreement. We will attempt to secure authorization upon submission of your order and your payment method will be billed with all charges appearing on your payment statement as Ethereal Designs. If there is an issue securing this authorization, we will notify you and prompt you to use another payment method. You will also receive an order confirmation at checkout along with an email confirming your order. A service fee for online orders and payments is applied for all orders. Prices as shown on the website are for products only. An additional delivery fee will be added to this order based on mileage and costs are clearly shown and invoiced on the order. We reserve the right to modify our prices based on fluctuating floral costs that are influenced by seasonal demands and availability. Sales tax will be charged where applicable. For any order unpaid after 30 days will result in an additional 2% interest rate each month thereafter with an annual rate of 24%. Failure to make payments as agreed may result in legal action against the client.

Consultations, Quotes & Contracts

Ethereal Designs LLC offers one-hour consultations, available either in-person or virtually, to help plan your special event. During the consultation, we may provide a preliminary quote, but the final quote will be presented in-person or electronically and requires your signature as part of the event agreement. This final quote serves as a contract, outlining the total cost of goods and services for the event date, as well as the terms and conditions. By signing the contract, you agree to pay the final cost in good faith. The final quote is our best estimate, but the actual cost may fluctuate up to $25 above the quoted amount due to changes in the flower market. This will result in an additional and final fee. A $200 down payment is required to book the event. 50% down payment of the final cost is required 60 days before the event, with a 1% late fee per day thereafter. The remaining balance is due 45 days before the event, also subject to a 1% late fee per day. Any event booked less than 30 days before the event will require full payment day of booking the event. The initial consultation is free of charge. Any additional consultations will incur a $50 fee, which will be credited towards the total event cost. Missed, canceled, or initial consultations that are not rescheduled within 24 hours will result in a $50 charge, with a 2% interest rate each month until paid in full. This is an annual rate of 24%. Failure to make payments as agreed may result in legal action against the client.

Terms and Conditions for Giveaways

**1. Eligibility:**
- The giveaway is open to residents of the 48 states who are at least 18 years old at the time of entry.
- Employees of Ethereal Designs LLC, their immediate family members, and anyone otherwise affiliated with the giveaway are not eligible to participate.

**2. How to Enter:**
- To enter the giveaway, participants must:
1. Like Ethereal Designs: A Floral Studio on Facebook or Instagram.
2. Follow Ethereal Designs: A Floral Studio on Facebook or Instagram.
3. Share the giveaway post on their own Facebook or Instagram feed or story, tagging Ethereal Designs: A Floral Studio in the post.
- Each participant must complete all three steps to qualify. Incomplete entries will not be considered.

**3. Entry Period:**
- The giveaway starts on September 1, 2024, and ends on September 24, 2024, at 11:59 PM Central Time.
- Entries submitted after the closing date will not be eligible.

**4. Winner Selection:**
- The winner will be randomly selected from all eligible entries.
- The drawing will be held on September 25, 2024, and the winner will be announced at 6 PM Central Time of that same day.

**5. Notification and Claiming Prize:**
- The winner will be notified via Facebook or Instagram Direct Message/Email within 24 hours of the announcement.
- The winner must respond within 48 hours of notification to claim the prize. If the winner does not respond within the specified time frame, a new winner will be selected.

**6. Prize Details:**
- The prize consists of floral and/or a gift certificate from Ethereal Designs LLC, along with varying prizes and/or gift certificates from local and/or regional businesses. Ethereal Designs LLC and participating businesses have the right to substitute products with gift certificates. Shipment of prizes will also determine varying substitutions.
- The prizes are non-transferable, non-exchangeable, and have no cash value.

**7. General Conditions:**
- By participating, entrants agree to abide by these terms and conditions and the decisions of Ethereal Designs LLC, which are final and binding.
- Ethereal Designs LLC reserves the right to disqualify any entrant who violates these terms or engages in fraudulent activity.

**8. Privacy:**
- Personal information collected during the giveaway will be used solely for the purpose of administering the giveaway and will not be shared with third parties except as required by law.

**9. Limitation of Liability:**
- Ethereal Designs LLC and any other business associated with the giveaway and prizes are not responsible for any technical issues, lost or delayed entries, or any other problems including adverse reactions to any or all of our products that may arise related to participation in the giveaway.

**10. Dispute Resolution:**
- Any disputes related to the giveaway will be governed by the laws of the state of Wisconsin and/or counties related to specific businesses in which they are established and resolved in the courts of Wisconsin and/or related counties to specific businesses in which they are established.

**11. Facebook/Instagram Disclaimer:**
- This giveaway is not sponsored, endorsed, or administered by, or associated with Facebook/Instagram.
